Terms & Conditions
These terms and conditions constitute the entire Agreement concerning the provision of our taxi service (“Service”) between YOU and Gerry’s Aviemore Taxis. It is understood that you are accepting of these terms and conditions set out in this agreement once you commit to booking a taxi with us or intend to use our taxi service.
- Booking
1.1 While booking a taxi please always allow enough/ sufficient time for the journey required. If you are unsure of travel time, please discuss this with the booking agent on the phone, through email or through our floating WhatsApp utility, and we will agree a sensible collection time for your journey.
1.2 Gerry’s Aviemore Taxis understand that taxi cancellations are inevitable. We ask proposed passengers to inform us of any cancellation as soon as is possible. Cancellations informed during our journey to collect you will incur a 50% charge of the journey booked with us. We will always use discretion when confronted with this situation as we understand life happens. However, a change of mind about your plans is not a reasonable excuse to cancel at such a late stage.
1.3 Legally speaking, children will have their own seat and we cannot permit children to travel sitting on an adult’s knee or lap as four passengers + 1 or 2 in our x 4 passenger vehicle.
1.4 Through experience and very rarely thankfully, passenger behaviour has necessitated the need to ask the passenger to refrain from anti-social or full-on obnoxious behaviour which is usually lubricated with alcohol. If the passenger refuses to behave in a more appropriate manner, they will be politely asked to disembark the taxi and pay for the journey up until the drop off venue decided by the driver.
- Waiting
2.1 Our driver will wait for a reasonable time of approximately 6 minutes after the initial booking time. The driver then will use discretion as to start the meter for the journey, which is calibrated to charge for time as well as distance. In most cases, this option is not initiated but there has been times that this has occurred. We will attempt to call the passengers of our position before initiating the meter.
2.2 Waiting at airport carparks are now a financial consideration. We will research airport parking charges at any airport we are contracted to pick up from. We will look to minimize or negate airport parking charges by moving away during the ‘grace’ time period allocated by the airport car park. However, there are many airports where a ‘pick up’ charge is unavoidable. In this case, we will factor this cost into the final taxi fare cost. This is usually £5.00 – £6.00.
- Payment
3.1 Payment can be made with card or cash. We use SumUp for card payments and on occasion there are areas where there is no data to complete a card transaction. If we know of these ‘dead’ areas before starting the journey, we will calculate the fare, based on the distance (excluding time in this circumstance) of the journey and ask the passenger to make the card payment at the time of pick up.
- The Service
4.1 When transporting children, we will attempt to cater for requests to provide child seats and boosters. When making a booking with us please ask if we have the appropriate seating for travelling children according to size and weight of the child/children. Please note that we are not obliged by our licence to do so.
4.2 We do accept dogs in our car but with a caveat. As a policy, we will not accept medium and larger dogs who moult or cast hair in abundance. It is fairly laboured process of removing said hair and we would rather not have to do this. Small dogs and dogs who do not cast hair are welcome to travel with their owners. This may qualify as ‘dogism’ but we hope you may understand our position.
4.3 We would hope that passengers will observe the usual protocols of not smoking, vaping, having lunch with beverages in our taxi. We will however, use discretion as to the consumption of small snacks and hydration which will create no or little debris in our taxi
- Liability
5.1 Gerry’s Aviemore Taxis shall not be liable for any loss due to the delays caused by the weather, road or traffic conditions which is beyond control on the journey. Under no circumstances shall Gerry’s Aviemore Taxis be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatever.
5.2 Gerry’s Aviemore Taxis shall be entitled to cancel all services and provide refunds in the event of an emergency, fuel shortage, extreme weather events, or other circumstances beyond its control. If the ctaxi vehicle breaks down during your journey, Gerry’s Aviemore Taxis will endeavour to arrange an alternative car to complete the journey as soon as practicable.
5.3 The travelling passenger shall compensate Gerry’s Aviemore Taxis against all the losses, costs, damages and expenses arising from any act or omission of any passenger/s in your party.
5.4 For any personal injury or death caused by negligence, or for willful default or fraudulent misrepresentation, or otherwise in any manner unenforceable by any applicable law, neither party excludes or limits its lability.
- Privacy & Data Protection
6.1 Gerry’s Aviemore Taxis shall store, process and use all information regarding your personal details in accordance with the requirements of the Data Protection Act 1998.
- Legal
7.1 This Agreement and any accompanying quotation represents the entire agreement between you and Gerry’s Aviemore Taxis in relation to its subject matter. If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.
